This privacy policy describes how Western Financial collects and uses the personal information you provide on our web site  https://www.westernfin.com and our mobile website.  It also describes the choices available to you regarding our use of your personal information and how you can access and update this information.

Western Financial is committed to protecting the confidential information you entrust to us. We carefully manage that information to provide you with high quality business financial products and services, and we never sell or share your information with non-affiliated outside parties other than what is stated in this privacy policy. Confidential information can include data you provide us on forms, data collected from third party credit reporting agencies, or data provided by references.

Protecting Your Confidential Information

We take seriously our obligation to safeguard your confidential information. Information is accessible only to employees who use it in order to provide products or services to you and your company. A Code of Conduct, set forth in our Employee Manual and other related documents dictates our expectations for professionalism and integrity and binds all of our employees. We also maintain physical, electronic, and procedural safeguards to ensure the confidentiality of your information. We monitor new technology and upgrade our systems as needed to best protect your information. When you enter sensitive information (such as a Social Security number) on our order forms, we encrypt the transmission of that information using secure socket layer technology (SSL). No method of transmission over the Internet, or method of electronic storage, is 100% secure, however.  Therefore, we cannot guarantee its absolute security. Protecting Disclosure of Information to Non-Affiliated Third Parties

We never sell confidential information to others. We may share information with other companies hired to provide services for us such as ordering credit bureaus, sending emails, and processing credit card payments. These companies – our vendors – are contractually bound to use personal information we share with them only to perform the services we have hired them to provide. We do not share, sell, or lease personal information about you to any third parties for their marketing use. We will release information about you if you direct us to do so, if we are required by law to do so, or in other legally limited circumstances (for example, to protect your account from fraud).

Collecting Information

We may gather confidential information from the following sources: information you provide on applications and through other forms, such as your name, address, Social Security Number, ACH bank information, credit card information, information from a credit reporting agency such as creditworthiness and credit history to help us with customer authentication, payment processing and credit-related decisions, or data from your use of our website. When you visit our mobile website, we automatically collect information on the type of device you use, operating system version, and the device identifier (or “UDID”).

Using Confidential Information to Serve You

In general, you can visit this website without telling us who you are or revealing any information about yourself. Our web servers collect the domain names, not the email addresses, of visitors. Our web servers also seek (as many websites do) to place a “cookie” (a small data file) on your computer’s hard drive which allows the server to determine the computer when it visits again, in order to track statistical information about navigation through our site. This cookie is not used to obtain your name or any personal data, and the information that is tracked is used only for internal purposes, such as to improve site navigation. Other Tracking Technologies

We do link this automatically collected data to other information we collect about you.

Technologies such as cookies, beacons, tags, and scripts are used by Western Financial and our partners, affiliates, or analytics or service providers. These technologies are used in analyzing trends, administering the site, tracking users’ movements around the site, and to gather demographic information about our user base as a whole. We also use mobile analytics software to allow us to better understand the functionality of our mobile website on your phone. This software may record information such as how often you use the site, the events that occur within the site, aggregated usage, performance data, and where the mobile site was accessed from. We do not link the information we store within the analytics software to any personal information you submit within the mobile site.

We utilize third parties, including Google, Inc., to either display advertising on our website or to manage our advertising on other sites. User Access and Choice

We will retain your information for as long as your account is active or as needed to provide you services.  We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Our website includes social media features, such as the Facebook, X, YouTube, LinkedIn, and Share This widgets, or interactive mini-programs that run on our site. Sources. We collect personal information directly from you, from your devices (cookies/SDKs), from service providers (e.g., identity verification, credit bureaus, analytics), and from public or commercial sources (e.g., business registries, marketing partners).

Purposes of use. We use personal information to:

  • Provide and service financing and related services; process applications; authenticate identity; detect/prevent fraud; perform underwriting and servicing; communicate with you; operate our websites/apps; personalize content; measure and improve marketing/advertising; comply with law; and protect our rights and users.

Disclosure. We disclose personal information to: service providers/contractors (e.g., hosting, analytics, fraud/ID verification, payment, customer support, marketing), financial institutions and dealers/vendors involved in your transaction, credit bureaus, and as legally required.

Selling/Sharing. We do not “sell” personal information for monetary or other valuable consideration. We do “share” personal information for the purpose of obtaining and servicing customer financing and for cross-context behavioral advertising (online targeted ads). See Your Right to Opt-Out of Sale/Sharing below.

Sensitive Personal Information (SPI)

What we consider “Sensitive” (as defined by CPRA) may include SSN, driver’s license/state ID, financial account details, precise geolocation, login credentials, racial or ethnic origin, union membership, mail/email content, genetic/biometric data.

Our use of SPI. We use SPI only as necessary to provide requested services (e.g., financing and required identity/credit checks), for security/fraud prevention, and as permitted by law. We do not use SPI to infer characteristics about you.

Right to Limit SPI. California residents may direct us to limit the use and disclosure of SPI to those needed to perform our services or as otherwise permitted by law.

Your California Privacy Rights

Subject to certain exceptions, California residents may exercise the following:

  1. Right to Know/Access. Request the categories and specific pieces of personal information we collected about you, the sources, purposes, and categories of third parties to whom we disclose it.
  2. Right to Delete. Request we delete personal information we collected from you.
  3. Right to Correct. Request we correct inaccurate personal information about you.
  4. Right to Opt-Out of Sale/Sharing. Direct us not to sell or share your personal information (including for cross-context behavioral advertising).
  5. Right to Limit SPI. Limit use/disclosure of sensitive personal information (see above).
  6. Right to Non-Discrimination. We will not discriminate against you for exercising any CCPA/CPRA rights (e.g., by denying services or charging different prices), except as permitted for programs reasonably related to the value of your data.

Verification. If we cannot verify your identity, we will explain why and may deny the request in whole or in part.

Response time. We aim to respond within 45 days of receiving a verifiable request. If reasonably necessary, we may extend by an additional 45 days and will notify you.

To opt out of sale or sharing of your personal information (including for cross-context behavioral advertising), use:

Retention
